Car Loses Control in Parking Lot and Crashed Through Building
An elderly lady was waiting in the lobby of a commercial building when a car crashed through the window, hitting her in the back with such force that her shoes came off. The impact resulted in traumatic brain injury and multiple fractures throughout her body. Initially, the building designer & its insurance company refused to pay for her injuries, arguing that the incident was unforeseeable. However, though thorough investigation and depositions, Mr Amendt was able to reveal that the designer had failed to consider the risk of out-of-control cars in the adjacent parking lot and did not install necessary barriers to protect the building and its occupants. Bad Lighting Caused Trip and Fall With Severe Injury
A visitor to an apartment building tripped and fell in the parking lot due to burned-out lights that were supposed to illuminate the area, but had not been replaced. The fall occurred in the handicapped parking space, which was improperly designed, with the tire stop, blue lines, curb height, and ramps not following handicap space rules. The visitor tripped over the tire stop, which was not visible because of the darkness. It resulted in a severe wrist fracture that required surgery with metal implants. Initially the insurance company refused to pay anything, but Mr Amendt and his team did a thorough investigation. They took pictures at night that clearly showed the poorly lit handicapped space compared to the well-lit adjacent areas. After seeing these photos and other evidence the insurance company agreed to pay out on the victims claim.
