How can I teach my child about pedestrian safety?

Pedestrian safety is important for everyone, but it's crucial for kids to learn at an early age. In this case, it's up to parents to ensure their children are playing it safe when out and about, especially when walking in highly congested areas. To help you help your kids, SafeKids.org offers the following tips.

What to do after a slip-and-fall accident at a grocery store

While running your errands at your local Pomona grocery store, the last thing on your mind may be suffering a serious injury. Yet, slip-and-fall accidents at grocery stores are common and can lead to injuries like broken bones, traumatic brain injury (TBI), spinal cord injuries and more.

What can I do is a dog chases my bike?

It's up to dog owners to keep control over their pets at all times. As many bicyclists are all too aware, this is not always the case. An aggressive dog is quite hazardous when riding your bike, which is why it's important to know the right tactics to evade and discourage any animals you come across. That's why Bicycling.com offers the following tips on what you can do when encountering a dog while out for a ride.

Careless business owners and pedestrian accidents

There are many different risk factors that pedestrians should take into consideration every time they go for a walk or go jogging, from adverse weather and the role that may play in an accident to visibility, the time of day and traffic congestion. There are many more reasons why pedestrian accidents keep happening, and in some cases, they may be the result of a business owner’s negligence. For example, a pedestrian may hurt themselves in a slip-and-fall accident because a business owner failed to take care of a leak or address ice or other hazards. Or, a pedestrian may be hit by a vehicle due to a careless business owner.

Describing the danger of eating while driving

While most in Pomona would point to drunk drivers as being those they most fear encountering while on the road, distracted drivers can be just as dangerous. Indeed, research information shared by the National Highway Traffic Safety Administration shows that 3,166 people were killed by distracted drivers in America in 2017. Most would likely classify distracted drivers as those who use their cell phones while behind the wheel, yet there is another form of driving distraction that is equally (if not more) prevalent: eating while driving.

Staying safe in a wheelchair as a pedestrian

Pedestrians face constant risks while walking on sidewalks, crosswalks, roads and more. Whether due to high speeds, distracted or intoxicated drivers, unprotected walkways or more, pedestrians can suffer serious or even fatal injuries when involved in an accident with motor vehicles.

Defining the "duty of care"

Many in Pomona often only consider premises liability cases through certain perspectives (e.g. slip-and-fall cases, animal attack cases). While these perspectives might be helpful if the circumstances of your case fall within them, they might make it difficult for you to determine if you the grounds for a claim in other (more general) scenarios. Here at Amendt Law, many often ask us if legal recourse is available to them under premises liability law. If you share the same question, we offer the same response to you: did the property owner in your case fulfill their duty of care?
